Terms of Use / End User License Agreement (EULA)

These Terms of Use (the “Terms”) constitute a legal agreement between you and AttendioAPP (“we”, “our”, “us”) governing your use of the AttendioAPP mobile application and related services (the “App”). By downloading, installing, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. License Grant & Restrictions

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to use the App on devices that you own or control, as permitted by the App Store Terms and conditions. You may not: (a) reverse engineer, decompile, or disassemble the App; (b) copy, modify, or create derivative works; (c) circumvent security or license controls; (d) use the App for unlawful purposes.

2. Account Registration

You must provide accurate information and maintain the security of your account. You are responsible for activities under your account. If you believe your account is compromised, notify us immediately at suport@attendioapp.com.

3. Subscriptions & In-App Purchase Disclosures

Auto-Renewable Subscriptions. The App offers auto-renewing subscription plans (e.g., monthly and/or annual), shown with title, duration, and price on the subscription screen in-app. Prices may vary by region and are displayed in local currency.

Payment: Payment is charged to your Apple ID account at confirmation of purchase.
Auto-Renewal: Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period.
Renewal Charge: Your account will be charged for renewal within 24 hours prior to the end of the current period.
Manage/Cancel: You can manage or cancel your subscription at any time in Settings > [your name] > Subscriptions on your iOS device.
Free Trial: If offered, any unused portion of a free trial period is forfeited when a subscription is purchased. Trials convert to a paid subscription unless canceled at least 24 hours before the trial ends.
Price Changes: If we change prices, you will be notified in-app and/or by Apple. Continued use after the change takes effect constitutes acceptance.
Refunds: Refunds are handled by Apple according to App Store policies. Please use reportaproblem.apple.com for refund requests.

4. Features & Fair Use

Subscription tiers may include limits (e.g., number of users, projects, or storage). We may apply reasonable technical limits to protect service stability. We may suspend or terminate access for abuse, fraud, or violations of these Terms.

5. Acceptable Use

Do not use the App to infringe privacy, intellectual property, or other rights.
No malware, scraping, excessive automated requests, or attempts to bypass security.
Respect applicable labor, privacy, and employment laws when using time tracking and geofencing features.

6. User Content & Data

You retain ownership of documents, records, and information you upload to the App. You grant us a limited license to process such data solely to provide and improve the services. We process personal data according to our Privacy Policy.

7. Third-Party Services

The App may integrate third-party services (e.g., Sign in with Apple/Google, notifications, maps). Your use of those services may be subject to their terms and privacy policies. We are not responsible for third-party content or services.

8. Service Availability & Changes

We may modify, suspend, or discontinue features at any time with reasonable notice when feasible. We aim to minimize downtime but do not guarantee uninterrupted service.

9. Intellectual Property

The App, including software, design, trademarks, and content provided by us, is protected by intellectual property laws. Except for the limited license above, no rights are granted to you.

10. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. YOUR USE IS AT YOUR OWN RISK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THE APP WILL NOT EXCEED THE AMOUNTS PAID BY YOU FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Termination

You may stop using the App at any time. We may suspend or terminate access for breaches of these Terms or if required by law. Upon termination, your license ends immediately.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of Portugal, without regard to conflict-of-law rules. Courts located in Porto, Portugal, shall have exclusive jurisdiction, unless mandatory consumer protection rules grant you different rights.

14. Changes to These Terms

We may update these Terms from time to time. The latest version will always be available at https://api.attendioapp.com/AttendioAPP/TermsOfUse. Material changes will be notified in-app or by reasonable means. Your continued use after changes become effective constitutes acceptance.

Appendix A — Required Subscription Disclosures (Apple)

Price: Displayed in local currency on the purchase screen; may vary by region and taxes.
